Architectural Committee

 

The RBSTC community, environment and ambiance can only be maintained through involvement of members and commitment to the Covenants, Conditions and Restrictions (CC&Rs) agreed to by each home owner. The RBSTC Architectural Committee exists to ensure fair and balanced adherence to the CC&Rs as well as supporting the preservation of our beautiful community and properties.

 

The Architectural Committee meets every Saturday (excluding holidays) at 8:30am at the front office.

 

Members of the Architectural Committee are:

Members of the Architectural Committee are appointed by the Board of Directors on an annual basis from members who volunteer.

The Architectural Rules and Procedures for the Club can be downloaded here.

 

Improvements and additions to your property usually require completion of a Property Improvement Form. This can be downloaded here and dropped off or e-mailed to the Architectural Committee. Forms must be submitted by close of business on Thursday prior to the Architectural Committee meeting on Saturday.

 

Complaints regarding possible violations of CC&Rs require completion of a Possible CC&R Violation Form. This can be downloaded here and dropped off or e-mailed to the Architectural Committee.

Governing Documents

 

The California Civil Code defines Governing Documents as all documents that govern a Common Interest Development such as the Rancho Bernardo Swim and Tennis Club Inc (RBSTC). The Civil Code also affords the various levels of Governing Documents an order of authority/or importance listed in order below:

 

The Law

 

The Davis Stirling Common Interest Development Act is the primary California Law that governs the actions of Common Interest Developments such as the Club.  In addition, sections of the California Civil Code, Corporations Code, and other laws generally take precedence over the Association’s documents unless the Law specifically gives precedence to specific portions of the Association’s documents.

CC&Rs

 

Covenants, Conditions and Restrictions (CC&Rs) are the primary governing documents of the Association.  Just as with the US Constitution, changes to CC&Rs are not taken lightly; therefore, they are very difficult to change, may take up to 2 years or more, and may place a substantial financial burden on the Association.  The Declaration of CC&Rs define the obligations of the membership to the association and vice versa.  CC&Rs generally cover restrictions on the use of property, member and association maintenance duties, enforcement powers for failure to conform, duty to pay assessments or face penalties, duty to insure, and dispute resolution.  All property owners in the RBSTC community are bound by their CC&R’s.

There are 33 CC&R’s that are administered by the Architectural Committee. While there are over 3,000 homes within our area, we only control the CC&R's about 1,600 homes. Specific CC&Rs can be downloaded by clicking on the relevant link in the right-hand column.

 

Articles of Incorporation and Bylaws

 

Articles of Incorporation declare that the RBSTC Inc. is an association formed to manage the common interest development.  The Articles also states the official name and address of the Association. Articles of Incorporation are filed with the Secretary of State.

 

Bylaws establish the policies and procedures of an association. They set such things as qualifications for directors, how many directors, terms of office, elections, their powers and duties, meeting requirements, committee appointments, etc.
